Teen on 63 counts of non-physical sexual assault sent to Henry Gurney School

PETALING JAYA
A Sijil Pelajaran Malaysia (SPM) student charged with 63 counts of non-physical sexual assault on male students has been ordered by the magistrates’ court in Batu Pahat, Johor, to be sent to the Henry Gurney School in Melaka.

Magistrate Suhaila Shafi’uddin ordered the 17-year-old to attend the school for three years, and instructed his parents to visit him once a month, Berita Harian reported.

She also ordered that he be placed under police supervision for one year and to report to the nearest police station once he completes his three years at the school.

“Repent, and use this punishment as an opportunity for self-reflection,” Suhaila told the student.

The order, effective today, is in accordance with Section 91(1)(f) of the Child Act 2001, as the teen is considered a juvenile offender.

Last month, the teenager pleaded not guilty to a total of 63 counts of non-physical sexual assault on male students, including one count of possessing child pornography.

However, he was reported to have changed his plea to guilty on Sunday.

The first to 62nd charges allege that he had committed non-physical sexual assault on seven male junior students, aged 13 to 17, by asking them to expose their bodies to him.

It was reported that the incidents took place at several school toilets, a surau and the homes of the victims in Batu Pahat, Kluang and Tangkak from December 2023 to last month.

The charges were framed under Section 15(a)(ii) of the Sexual Offences Against Children Act 2017, which carries a punishment of 10 years in jail or a fine of not more than RM20,000, or both, for each charge.

The final charge alleged that the accused was in possession of child pornography videos, punishable under Section 10 of the same Act with five years jail, fined up to RM10,000, or both, if found guilty.

It was reported that he allegedly asked his victims to perform and record indecent acts before handing the videos to him.

The prosecution was handled by deputy public prosecutor Farah Wahidah Sharip, and the teenager was represented by lawyer Razak Sharif. - FMT
