
PETALING JAYA: Sabah assembly speaker Kadzim Yahya is holding off on declaring Peter Anthony’s Melalap state seat vacant pending a confirmation on the date of his application to review his forgery conviction.
Kadzim was quoted in media reports as saying Peter’s legal team had written in to inform him about their intention to file the application, but he wanted a formal notification from the lawyers.
“If the (application) was filed on or before March 18, he is still within the 14-day period. However, if it was filed after the deadline, the seat will be automatically vacated,” he was quoted as saying.
Under the Sabah state constitution, a nominated or elected assemblyman would be disqualified if convicted and sentenced to at least a year in prison or fined a minimum of RM2,000.
The disqualification takes effect 14 days after the court’s decision if no appeal or court proceeding was brought.
Peter is currently serving a three-year jail sentence after his final appeal to set aside his conviction was dismissed on March 4. FMT reported yesterday that he filed his application for an appeals court review on March 14, which would be 10 days after his final appeal failed.
He was convicted for forging a letter from the office of the Universiti Malaysia Sabah deputy vice-chancellor 11 years ago in connection with a maintenance and service contract.
He was also fined RM50,000 by the sessions court in Kuala Lumpur in 2022. He has paid the fine.
