Jail and fine for drunk driver who drove into cop

KUALA LUMPUR: The magistrates’ court today sentenced a man to four years’ jail and a RM15,000 fine after finding him guilty of driving under the influence of alcohol and causing the death of a policeman and injuring another.

Magistrate Puteri Nursheila Rahimi handed down the sentence on N Mohan Rao, 48, after finding that the defence had failed to raise reasonable doubt against the prosecution’s case.

She also ordered Mohan’s driving licence to be suspended for five years.

The court, however, allowed a stay of the sentence pending an appeal by the accused to the High Court.

Mohan was charged with driving under the influence of alcohol, with his blood alcohol level in excess of the permitted limit, and causing the death of Zamiri Sinsian, 25, and injuring Osman Ibrahim, 23, at Jalan Semantan at 3.30am on Dec 5, 2018.

The Road Transport Act 1987 provides for imprisonment of up to 10 years and a fine up to RM20,000 upon conviction.

A total of 17 witnesses, including two for the defence, were called during the hearing of the case, which began in 2019. - FMT
