Court frees eye doctor, sets aside ganja cultivation conviction

TAWAU: The High Court here has set aside a 30-year jail term imposed on an ophthalmologist for cultivating 12 ganja plants in his house compound two years ago.

Judge Lim Hock Leng said the prosecution had failed to prove Azril Surash Masree Samy had knowledge that the plant he was cultivating was forbidden under the law.

Lim said the written grounds on why he allowed Surash’s appeal would be provided later.

Surash, 45, is said to have committed the offence at Taman Mega Ria here, on Aug 3, 2020.

Deputy public prosecutor Hurman Hussain appeared for the prosecution while Surash was represented by Mark Rosaidey Amin Jaafar and Nazreen Jaafar Abdullah Jaafar.

On Jan 27, sessions court judge Kerisnada Mahmud sentenced Surash to the maximum life imprisonment of 30 years after finding the prosecution had proven its case beyond reasonable doubt.

The sessions court also ordered Surash to be whipped six times, the minimum allowed under the law. Surash subsequently filed an appeal. - FMT
