The Kuala Lumpur High Court has ordered former Padang Serai MP N Gobalakrishnan to pay RM150,000 in damages to a former Sungai Siput PKR branch treasurer and her husband - who is also a pilot of a commercial airline.
Judicial commissioner Raja Ahmad Mohzanuddin Shah Raja Mohzan today allowed the civil action against the former lawmaker by the two plaintiffs, R Indrani and S Selvakumar.
The couple’s lawyer Rueben Mathiavaranam, this afternoon, confirmed the outcome of the proceedings.
According to the counsel, the couple filed the defamation action against the defendant for allegedly publishing three defamatory publications on June 4, 2019. The plaintiffs filed the civil action on Nov 7, the same year.
The publications allegedly consisted of two WhatsApp picture messages and a WhatsApp voice message, accusing the couple of having cheated many businesspersons, among other claims.
“The court found all three publications to be defamatory of the plaintiffs and without any basis.
“The defendant had also filed a counterclaim against Indrani, claiming that she had defamed him in a separate voice message she had made. The court dismissed the defendant’s counterclaim for lack of evidence.
“The court then awarded Selvakumar RM50,000 while Indrani was awarded RM100,000 in damages. The defendant was ordered to pay the plaintiffs’ costs in the sum of RM40,000.
“All in all, the defendant was ordered to pay RM150,000 damages and costs in the sum of RM40,000,” Rueben said.
Malaysiakini is attempting to reach out to Gobalakrishnan’s legal team over the matter.
Checks on the judiciary’s official website listed the civil action as set for clarification, as well as a decision before Raja Ahmad Mohzanuddin. - Mkini
