I sell food to support my 3 sons, says businessman’s ex-wife

KUALA LUMPUR: Emilia Hanafi, the former wife of businessman SM Faisal SM Nasimuddin, told the magistrates’ court here today she had to work part-time selling food and doing home decoration to cover her children’s expenses.

Emilia, 43, said she chose to work part-time because she had to see to her three sons, aged 17, 12 and 10, including sending and fetching them from school.

“I support my children by selling food cooked at home,” she said during examination-in-chief by deputy public prosecutor Nur Aishah Ahmad Zakiuddin at the trial of Faisal, who is charged with voluntarily causing injury to her.

Emilia, who is the seventh prosecution witness, said she took up a part-time job to support her family as the interim maintenance payment of RM2,000 for each child was insufficient.

“At the moment, my three children and I are staying at my parents’ house,” she said.

Earlier, the court allowed the application of lawyer Akberdin Abdul Kader, representing Faisal, for Emilia to be called despite an objection from the prosecution.

DPP Zahida Zakaria told the court she would file a revision application against the court’s order for Emilia to testify.

Today’s hearing was supposed to proceed with the cross-examination of the sixth prosecution witness, Elisa Nani, the younger sister of Emilia. However, Akberdin applied for Emilia to be called to testify first as she was an important witness for the prosecution.

Faisal, 43, is charged with voluntarily causing hurt to Emilia at a house in Desa Sri Hartamas here between 12.30pm and 4.30pm on Nov 22, 2015.

The charge was framed under Section 323 of the Penal Code and is punishable under Section 326A of the same code, which provides for imprisonment of up to two years or a maximum fine of RM2,000 or both, if convicted.

The hearing before magistrate Nadia Othman continues on Feb 28.
