Papagomo’s defence called for allegedly causing hurt to Syed Saddiq

KAJANG: Former blogger Wan Azri Wan Deris – better known as Papagomo – was today told to enter his defence on a charge of voluntarily causing hurt to former youth and sports minister Syed Saddiq Syed Abdul Rahman four years ago.

Magistrate Noor Firdaus Rosli said the prosecution had proved all elements of the charge.

“I hereby call the accused to enter his defence as the prosecution has established a prima facie case,” Firdaus said in an oral ruling.

The former Umno Youth executive council member allegedly committed the offence at Persiaran Impian Perdana, Saujana Impian, here, about 11am on Feb 16, 2019.

He is also said to have caused injuries on the neck and shoulder of Syed Saddiq, the founder of Ikatan Demokratik Malaysia (Muda) and the current Muar MP.

The charge provides for a one-year jail term or a fine of up to RM2,000 or both, upon conviction.

Firdaus, however, amended another charge brought against Papagomo for outraging the modesty of Syed Saddiq to one where he allegedly committed a breach of peace.

The 40-year-old businessman was said to have uttered the words “you are stupid” at the same time and place.

Firdaus said the prosecution failed to prove the elements of the charge, but succeeded in establishing a prima facie case under Section 14 of the Minor Offences Act 1955.

“Though the words uttered may be vulgar, it did not insult the modesty of Syed Saddiq,” he said.

Firdaus said he was framing the charge under the Minor Offences Act as Papagomo’s utterance might result in a breach of peace.

If convicted, Papagomo may be liable to a maximum fine of RM100.

He pleaded not guilty to this offence.

The court has fixed Papagomo’s defence to be heard on May 22 and 23, and June 12 and 13.

Lawyers Logen Eskander and Nik Saiful Adli Burhan appeared for Papagomo while deputy public prosecutor Nurfarhanim Abdul Halim prosecuted. - FMT
