Trio challenge Saifuddin’s exemption of Umno’s no-contest for top 2 posts

 

On Jan 14, the 2022 Umno annual general assembly approved a motion of ‘no-contest’ for the posts of president and deputy president.

KUALA LUMPUR: Three Barisan Nasional (BN) members have filed a bid before the High Court to challenge home minister Saifuddin Nasution Ismail’s decision allowing the top two posts in Umno to be uncontested at the recent party polls .

Satarriah Abdul Karim and Zaidi Abdul Majid are members of the Kampung Bukit C2 Lembah Pantai Umno branch, while P Vellasamy is an MIC member from its Lembah Pantai branch.

They said Saifuddin had in March confirmed granting a no-contest exemption for the party’s president and deputy president posts.

At the 2022 Umno annual general assembly on Jan 14 this year, the party had approved a motion for the post of president and deputy president not to be contested at the party elections.

Satarriah, Zaidi and Vellasamy claimed Saifuddin’s decision contravened Article 8(1) of the Federal Constitution on equality, adding that it had denied other members the chance of challenging the incumbents for the post of president and deputy president.

“The applicants were denied their rights to be heard by the minister before coming to his decision.

“Until today there is no reasonable explanation from the minister for his decision,” they said in their leave application.

The trio pointed out that the Registrar of Societies (RoS) had launched a probe of possible violation of Umno’s constitution over the no-contest motion for the top two posts.

“The minister’s decision was unreasonable and it contradicted Umno’s constitution,” they added.

The trio wanted the court to quash Saifuddin’s decision exempting the posts from being contested.

Besides Saifuddin, they have also named Umno and RoS in their legal challenge.

Justice Amarjeet Singh will hear their application for leave to commence a judicial review of the decision this Thursday. - FMT
