Justice Evawani Farisyta Mohammad granted MTUC leave on July 13 to commence judicial review proceedings challenging its temporary dissolution.
She also ordered the suspension of the dissolution pending the disposal of the judicial review application.
Evawani ruled that suspending the order was necessary to enable MTUC to continue acting for workers and to allow payments to auditors who were reviewing the financial reports sought by the RoS.
On May 7, the RoS ordered that MTUC be provisionally dissolved after allegedly failing to comply with a directive to submit key documents to the registrar.
The RoS said that MTUC failed to submit two key categories of information – audited financial statements and details of foreign funding – as required under the notice.
In its submissions, MTUC said it had submitted seven of nine categories of documents sought by the RoS and requested an extension of time for the remaining reports.
It said the RoS turned down the request without explanation.
MTUC secretary-general Kamarul Baharin Mansor and the National Union of Bank Employees then filed for leave to apply for a judicial review, naming the RoS, home minister and human resources minister as defendants.
The plaintiffs are seeking an order of certiorari to quash the RoS’s decision to provisionally dissolve MTUC.
Ravi Nekoo and M Arvin Kumar acted for MTUC while senior federal counsel Husniyyah Hanapi appeared for the defendants.
