Lawyers say the wife of the former prime minister will seek further court orders to protect her position pending appeal against the High Court award.
Rosmah’s lawyers, Reza Rahim & Rajivan, said she was studying the implications of the appellate court’s decision and would file any necessary application before the High Court or Federal Court to preserve her rights pending her appeal.
“Any attempt by Global Royalty Trading SAL to enforce or execute the High Court decision shall be resisted vigorously by our client,” they said in a statement.
The firm said the wife of former prime minister Najib Razak continued to maintain that Global Royalty’s claim against her was without basis in fact and law.
Earlier today, the Court of Appeal dismissed her application for an unconditional stay pending disposal of her appeal, which is fixed for hearing on March 25 next year.
A three-member bench chaired by Justice Firuz Jaffril, with Justices Amarjeet Singh and Aliza Sulaiman, also ordered Rosmah to pay RM30,000 in costs.
Firuz told Global Royalty’s counsel, David Gurupatham: “You can do whatever you want (to enforce the High Court judgment).”
On June 10, High Court judge Quay Chew Soon allowed Global Royalty’s suit and ordered Rosmah to pay about RM67.5 million within a month over 43 pieces of jewellery allegedly supplied to her on consignment in 2018.
The Lebanon-based company said the jewellery, worth US$14.57 million, remained its property and had not been returned.
On Aug 12, Judicial Commissioner Marianne Antoinette Ghani granted Rosmah a conditional stay, requiring the judgment sum to be placed in a joint account held by the solicitors for both parties.
Rosmah then sought an unconditional stay from the Court of Appeal.
Her lawyers said she filed her appeal against the High Court ruling on June 12 and intended to pursue it. - FMT
