Resolving the Negeri Sembilan constitutional crisis

 The federal government should advise the Yang di-Pertuan Agong to declare a localised state of emergency to break the impasse.

The escalating constitutional crisis in Negeri Sembilan — triggered by the Undang Yang Empat’s attempt to depose the Yang Dipertuan Besar Tuanku Muhriz Tuanku Munawir, and the resulting executive deadlock — demands a swift resolution rooted in the rule of law. Left unaddressed, any verdict risks rejection by opposing factions, threatening total administrative collapse.

To break the impasse and preserve public welfare, the federal government should advise the Yang di-Pertuan Agong to declare a localised state of emergency under Article 150 of the Federal Constitution.

This mechanism offers the cleanest path forward. Much like the 1977 Kelantan precedent under then prime minister, Hussein Onn, an emergency would freeze political manoeuvring, suspend the state constitution, and allow a neutral, non-political caretaker administrator to maintain governance.

Crucially, this intervention provides the stability needed for a definitive legal remedy. Under Article 34 of the Negeri Sembilan constitution, the ruler can make a formal reference to the Federal Court for an authoritative opinion.

With the emergency preventing rival factions from sowing chaos, the apex court can dispassionately evaluate whether the Undangs adhered to due process and Adat Perpatih (customary law), and whether the subsequent dismissal of the state executive council holds legal weight.

Alternative pathways may fall short. Mediation by the Conference of Rulers or dissolving the state assembly to hold fresh elections might address political symptoms, but neither can decisively resolve the underlying royal dispute. Factional discontent among the Undangs would likely persist.

A full panel review by the Federal Court remains the only mechanism capable of delivering a legally binding, indisputable verdict.

By combining an immediate emergency declaration with an expedited apex court reference, Malaysia can safeguard institutional order and decisively restore the rule of law in Negeri Sembilan. - FMT
