The Kuala Lumpur High Court has rejected the leave application for a judicial review against the Atomic Energy Licensing Board's (AELB) approval of a temporary operating licence to Lynas Corporation to operate a rare earth refinery.
The application was filed by 10 residents from Gebeng, Kuantan, where the refinery is located.
The leave was dismissed by Justice Rohana Yusof on grounds that the application is premature as there is an appeal pending before the Science, Technology and Innovation Minister that is set to be heard on April 17.
Rohana also cited the formation of the parliamentary select committee (PSC) to investigate the safety standards of the Lynas Advanced Materials Plant (LAMP).
