Court allows PKR election petition for Kota Marudu parliamentary seat
The PKR's election petition for Sabah's Kota Marudu parliamentary seat has been allowed by the Election Court - the first against a Barisan Nasional-held seat.
The seat was won by PBS deputy president Datuk Dr Maximus Ongkili (pic) who defeated Datuk Maijol Mahab in a four-cornered contest in the May 5 general election.
However, the Star online reported that the court cleared Dr Ongkili of any wrongdoing in the polls for the northern Sabah seat.
Election judge Yew Jen Kie allowed Dr Ongkili's preliminary objections to the petition brought by Maijol.
This is the second polls petition which had gone beyond preliminary stage.
Earlier this month, Yew had allowed the Barisan petition for the Klias state seat won by PKR's Datuk Lajin Ukim which will be heard in September.
In his petition, Maijol had, among others, alleged the Energy, Green Technology and Water Minister was non-compliant of the electoral rules as well as corrupt practices in the May 5 polls.
Maijol's petition against Returning Officer Lovita Koisun and the Election Commission will be heard for 10 days, beginning August 19.
Dr Ongkili, named as the first petitioner, won the seat by a majority of 842 votes. He secured 15,168 votes against Maijol's 14,326, in a contest that included State Reform Party's Majamis Timbong (2,228 votes) and Yuntau Kolod of the Sabah Progressive Party (444 votes).
Ongkili, was represented by counsel Chin Teck Ming, Peter Jino Allion and Raymond Szetu.
Lovita and the EC were represented by senior federal counsel Zawawi Ghazali while Mark Sitiwin acted for Maijol.
