PETALING JAYA: A sweeper was sentenced to two years’ imprisonment at the Alor Setar sessions court after being found guilty of sending explicit videos involving swingers through X.
The accused, Kamarulnazri Desa@Yahaya, 45, from Jitra, had pleaded guilty to the charges read out by an interpreter before judge Mazdi Abdul Hamid.
He was accused of knowingly using an account on the X social media platform to send offensive and obscene videos intended to cause distress to others on Jan 26 and Feb 4, Berita Harian reported.
Kamarulnazri was also accused of distributing obscene content through the same X account, specifically a video via a Telegram link for commercial purposes to others on Feb 8 and 17.
The authorities detected the content at the Kubang Pasu police headquarters in Jitra on Feb 20.
The charges were framed under Sections 233(1)(a) and 233(2)(a) of the Communications and Multimedia Act 1998, which carry a maximum fine of RM50,000 or a maximum one-year prison sentence, or both, upon conviction.
The facts of the case also revealed that the accused had sold the group-sex videos for RM100, based on a payment receipt found during investigations.
Deputy public prosecutor Fatin Hadni Khairuddin from the Malaysian Communications and Multimedia Commission handled the prosecution while the accused was unrepresented.
The accused had pleaded for a lighter sentence, given his job as a general cleaning worker with a monthly income of RM1,500. He is also supporting his wife, elderly grandmother, and four children, two of whom are attending university.
The prosecution, however, argued for a severe sentence due to his involvement in uploading a video promoting group-sex activities, including one of his wife having intercourse with another man while the accused watched.
Fatin also said the video was subsequently sold to the public and that an MCMC probe found numerous videos owned by the accused uploaded onto his social media accounts since 2016.
The judge then imposed a fine of RM80,000, with a two-year prison sentence if the fine was not paid.
At 4pm, Kamarulnazri failed to pay the fine and was taken to Pokok Sena prison to serve the sentence. - FMT
