Urimai files judicial review bid for registration

The pro tem committee of the United for Rights of Malaysians (Urimai) party has applied for a judicial review in its bid to be formally registered as a political party.

This came after the Registrar of Societies (ROS) rejected its application in July.

According to its application papers filed at the Kuala Lumpur High Court yesterday, they sought a mandamus order to compel the ROS to reverse its decision and register Urimai as a political party.

Alternatively, they want the court to compel the home minister to hear and decide on Urimai’s appeal against the ROS’ decision to reject its registration.

If granted by the court, they want either order to be carried out within 14 days of the court decision.

They are also seeking a court declaration that either the ROS decision to reject their application and/or the minister’s inaction over their appeal amounted to a violation of their right to association under Article 10(1)(c) of the Federal Constitution.

No orders as to cost are being sought.

The suit was filed through the law firm Gunamalar Law Chambers, with Urimai pro tem committee secretary Satees Muniandy as the plaintiff.

The home minister is named as the first respondent and the ROS as the second.

‘No choice’

In a statement, Satees said the government’s actions leave Urimai no choice but to seek redress in court.

“Formation of this party is our constitutional right as enshrined in Article 10(1)(c) of the Federal Constitution.

“When the Madani government continue to walk on the path of their predecessors in refusing the constitutional rights of Malaysians, despite their reform rhetoric of the past, we have no choice but to refer to the court to protect and uphold our fundamental right,” he said.

The case is slated to be heard before judge Hayatul Akmal Abdul Aziz on Jan 27 next year.
