Padungan assemblyman Wong King Wei, who is helping the family to initiate proceedings, says the Public Works Department’s safety guidelines were not adhered to at the accident site.
PETALING JAYA: The family of Dina Dzulkarnain Asan has begun legal proceedings against the relevant authorities for alleged negligence that led to his death in a road accident at Padang Merdeka in Kuching last month.
Dina’s family has sought the help of Padungan assemblyman Wong King Wei to initiate proceedings against Kuching North City Commission (DBKU) and the state government.
“We are now compiling all the necessary evidence including photographs of the scene before and after that accident,” the Borneo Post Online quoted Wong as saying.
Wong said they were also compiling other relevant documents such as police reports and the post-mortem report before initiating the legal process.
“The Public Works Department’s safety guidelines were not adhered to at the accident site,” he said.
Dina, 29, is believed to have died after the motorcycle he was riding skidded and plunged into a metre deep hole for an ongoing flood mitigation project at Padang Merdeka on Dec 26.
He was found submerged in the water by members of the public.
Wong said Dina’s family members had stressed that compensation was secondary.
“What is more important is that a lesson must be learnt by all the public authorities, especially when they are carrying out any construction in a public place or on a public road,” Wong was quoted as saying.
He said the public authorities must ensure that safety measures were well taken care of so that unfortunate incidents or fatal accidents would not recur in the future. -FMT
