DAP leader seeks to quash ruling in UUM lecturer’s suit

 


A Sarawak DAP leader will apply to set aside a Kuala Lumpur High Court ruling that he pays RM8 million in damages to a Universiti Utara Malaysia (UUM) professor in a defamation suit.

The party Batu Kitang chairperson Abdul Aziz Isa (above) today said he has consulted with his lawyers on the filing of the setting-aside application against the ruling, issued in the suit against him by Kamarul Zaman Yusoff.

Abdul Aziz, who is also the special assistant to Stampin DAP MP Chong Chieng Jen, was responding to Kamarul’s Facebook post where the latter claimed to have been granted the Judgment in Default by the Kuala Lumpur High Court on Nov 6.

Under the law, a plaintiff may apply for a Judgment in Default of Appearance if the defendant fails to enter an appearance in a legal matter, within a certain period of time after service of the cause papers by the plaintiff.

Abdul Aziz today claimed that he has never received the Writ of Summons from Kamarul’s lawyers, hence not being aware whether the cause papers have been served on him.

The defendant claimed that he only became aware of the High Court ruling through social media when the plaintiff posted the news on the latter’s Facebook account yesterday.

“Such news caught me by surprise. I was kept in the dark on how a judgment in default of appearance had entered upon when I have never received the Writ of Summons and SOC (Statement of Claim) in the first place.

“As such, I have consulted my lawyers to make an application to set aside this judgment,” Abdul Aziz said.

On June 26, it was reported that Abdul Aziz received a letter of demand from Kamarul’s lawyers over the DAP leader’s Facebook post in June 2017.

Aside from Abdul Aziz, Kamarul (above) has also initiated a series of legal actions against other DAP leaders such as Iskandar Puteri MP Lim Kit Siang, Seputeh MP Teresa Kok, Kepong MP Lim Lip Eng, DAP's former vice-chairperson Ariffin Omar, and Chong, among others.

He had also previously announced his intention to sue three other DAP leaders, namely Perai assemblyperson P Ramasamy, Seri Delima assemblyperson Syerleena Abdul Rashid and Aziz. - Mkini
