Dec 17 hearing of appeal over AIAC ex-director’s immunity

 


A former Asian International Arbitration Centre (AIAC) director’s application for leave to appeal over his bid for immunity from prosecution will come up for hearing before the Federal Court on Dec 17.

Lawyer K Shanmuga, who represents appellant N Sundra Rajoo (above), today confirmed the hearing date.

“It (Federal Court hearing of Sundra Rajoo’s bid for leave to appeal) has been set for hearing on Dec 17,” the lawyer told Malaysiakini.

Shanmuga added that the apex court proceedings at the moment are fixed as a physical hearing, because the current conditional movement control order (MCO) in Putrajaya, Selangor and Kuala Lumpur is set to expire on Dec 6.

On Nov 7, it was reported that the conditional MCO over Putrajaya, Selangor and Kuala Lumpur was extended to Dec 6. 

Checks of the online cause list showed that the matter is fixed for hearing before the Federal Court at 9am on Dec 17.

On June 25, the Court of Appeal set aside a Kuala Lumpur High Court ruling that Sundra Rajoo was immune from prosecution for alleged acts perpetrated while in office. 

On Dec 31 last year, the Kuala Lumpur High Court had allowed Sundra Rajoo’s judicial review which sought to uphold his immunity from prosecution. 

The High Court had granted him a declaration that he was immune as a former high ranking AIAC officer for acts purportedly done in his official capacity.

Sundra Rajoo headed AIAC from 2010 until late 2018.

On Jan 22 this year, the Kuala Lumpur Sessions Court struck out the three criminal breach of trust (CBT) charges against Sundra Rajoo in relation to over RM1 million in AIAC funds. 

The lower court had ruled that it was bound by the High Court verdict that the accused was entitled to the immunity from prosecution.

On March 11 last year, it was reported that Sundra Rajoo filed the judicial review application to uphold his immunity from possible arrest and prosecution.  - Mkini
