Court acquits ustaz of 3 charges of sexual assault on boys

KULIM: The sessions court here has acquitted a principal of a religious school on three charges of sexual assault and granted him a discharge not amounting to an acquittal (DNAA) on another two charges after one of his alleged victims admitted to having lodged a false report two years ago.

Anuar Che Ani, 36, was charged on Nov 18, 2021 with sexually assaulting five boys aged 11 to 14 at his madrasah here on different occasions between April 2018 and October 2021. He was charged under Section 14 (a) of the Sexual Offences Against Children Act 2017.

He pleaded not guilty and was granted bail of RM50,000.

According to his lawyer, RSN Rayer, Anuar was acquitted and discharged for the first three charges after one of the complainants admitted during cross-examination that he had lodged a false complaint against him.

Rayer said Anuar was granted a DNAA on the remaining two cases.

He said the DNAA decision was made by sessions court judge Mirza Mohamad following an application by the prosecution after two key witnesses who were supposed to take the stand today failed to turn up.

During an earlier cross-examination, the first witness had told the court he and his four friends framed Anuar after they were caught with pornographic materials in the madrasah, he said.

“The boys lodged a police report on the same day after my client disciplined and castigated them. During cross-examination, one of the complainants admitted to having lodged a false report against my client,” Rayer said. - FMT
