PETALING JAYA: An election court in Melaka has declared Bersatu’s Mas Ermieyati Samsudin the Masjid Tanah MP after rejecting an election petition filed by her Barisan Nasional opponent during the general election (GE15).
Justice Anselm Charles Fernandis also ordered BN’s Masjid Tanah candidate in GE15, Abdul Hakim Abdul Wahid, to pay costs to the former deputy law minister, according to Berita Harian.
Fernandis said he accepted a preliminary objection raised by Mas Ermieyati that the petition had been filed out of time.
Section 38 of the Election Offences Act 1954 states that an election petition must be presented to court within 21 days of the publication of an election result.
Hakim’s petition, which was filed on Jan 3, sought to nullify Mas Ermieyati’s GE15 win by claiming that the Perikatan Nasional candidate handed out cash bribes and threw feasts to woo voters.
Delivering his judgment, Fernandis said Hakim failed to explain in detail his claims of bribery and how Mas Ermieyati was linked to several other individuals named in the petition.
In GE15, which took place on Nov 19 last year, Mas Ermieyati successfully held on to her parliamentary seat, pulling a majority of 4,411 votes in a four-cornered contest. - FMT
