Kg Hakka folk brings 'police abuse' claim to Suhakam


Residents from Kampung Hakka, Negri Sembilan has urged the Human Rights Commission (Suhakam) to probe alleged police abuse of power when evicting  them on Sept 30. 
 
During a meeting with Suhakam officers today, the villagers spoke of how they were assaulted and detained during the eviction process, which they claim to be unlawful in the first place. 
 
The residents had received an order from the High Court on Sept 25 to vacate the their homes within seven days, however the police came to evict them in just five days. 
 
kampung hakka suhakam 071011The villagers had submitted video clipswhich depicted police personnel lining up in front of a house before charging and arresting people who were trying to protect their homes. 
 
Among those who were injured was Chong Pit Kee, 41, who dislocated her elbow and broke her wrist during the scuffle. Twelve people were detained following the incident. 
 
According to PSM secretary-general S Arutchelvan told Suhakam that one PSM member, known only as Murugan, was slapped by the police after he was detained. 
 
"Murugan was injured because the officer wore two large rings on his fingers," said Arutchelvan, whose party is assisting Kampung Hakka residents.

Arutchelvan also told Suhakam that the bailiff had allegedly acted unfairly by insisting on demolishing the two houses on 11am on that day while refusing to wait for the resident's lawyers to arrive. 
 
He added that all detainees were denied access to legal representation. 
 
This is the second complaint lodged by Kampung Hakka residents to Suhakam. The first complaint resulted in Suhakam writing to the land office to stop the eviction process, but to no avail. 
 
kampung hakka suhakam 071011Speaking to reporters later, Arutchelvan said that it was impossible for the residents to be subject to eviction because they all had temporary occupation licences.  
"Temporary occupation licence (TOL) is only given to state land. How can people be paying for their TOL and yet the developer Mega 9 Sdn Bhd suddenly said they are the owner of the land?” asked Arutchelvan. 
 
Arutchelvan said he had also urged Suhakam to help facilitate a meeting between the developer and residents to find an amicable solution.
