MCA explains why it now supports PCA
MCA MPs voted for the Prevention of Crime (Amendments and Extension) Bill 2013 because there were sufficient safeguards against abuse that will be in place, the party said today.
In a press release, the party argued that law had ensured that detention orders cannot be ordered by the executive branch of the government.
Instead, detention orders can only be issued by a five-member board headed by a senior ex-judicial officer and any decision is subject to review by the High Court.
"In other words, detention order is no longer decided by the Minister or the executive branch of the government," said the party.
The party said detention orders will also be scrutinised by the Dewan Rakyat annually and the law was subject to review every five years.
"With the new safeguards and judicial supervision in place, MCA is prepared to accept the government’s proposal in good faith, especially bearing in mind the pressing needs to fight crime problems that we are facing.
"MCA will keep a close watch on the implementation of PCA and will not compromise should there be any cases of abuse," read the statement.
MCA and Gerakan leaders have openly spoken against the amendments on grounds that detention without trial should not be allowed.
However, all MCA and Gerakan MPs voted in favour of the amendments when a vote was held this morning, drawing ridiculefrom their Pakatan Rakyat counterparts.
