Their application to dismiss the charge was rejected by High Court judge Kamardin after hearing submissions from deputy public prosecutor Mohamad Abazafree Mohd Abbas, and counsel N. Surendran, who represented Tian Chua, 51, Adam Adli Abd Halim and Hishamuddin Rais.
He then ordered the case to be remitted to the Sessions Court, Bernama reported today.
Tian Chua, the Batu MP, Adam Adli, 25, and Hishamuddin, 62, had first applied to drop the charge against them in February but it was dismissed on February 18 by the High Court on the grounds that it was premature and without merit.
The trio had been charged with sedition after making speeches at the Kuala Lumpur and Selangor Chinese Assembly Hall in Jalan Maharajalela, Dang Wangi on May 13, 2013.
On March 5, they made another attempt to quash the sedition charge.
Kamardin, according to Bernama, said the court was bound by a Court of Appeal decision on November 29, 2013, which rejected Tian Chua's appeal against another sedition charge made in relation to the Lahad Datu intrusion in Sabah.
