Permatang Pasir state assemblyperson Muhammad Faiz Fadzil has pleaded not guilty and claimed trial to a charge for alleged sexual assault under Section 354 of the Penal Code at the Shah Alam Magistrate's Court today.
He was accused of using criminal force with intentions to outrage the modesty of a 31-year-old woman on March 8, between 9.45pm and 11.30pm, while they were both in a car traveling from Sunway Pyramid shopping mall to Subang Jaya, Selangor according to the draft charges sighted by Malaysiakini.
When contacted, DPP Zahida Zakaria, from the Attorney-General's Chambers' sexual crime unit, confirmed the charge against Faiz, which was read before Magistrate Mohamad Redza Azhar Rezali.
Zahida said the Amanah politician was released on a RM10,000 bail and with the condition to not disturb the prosecution's witnesses.
"The next date set is Aug 6 for submission of documents," Zahida told Malaysiakini today.
The woman was previously identified by online portal MalaysiaNow in a March 24 report as a PKR member.
Faiz, who is also an Amanah central committee member, had at the time denied all allegations and confirmed cooperation with a police probe following the woman's report lodged on March 16.
DPP Nur Aishah Ahmad Zakiuddin also appeared for the prosecution while Faiz was represented by Abdul Aziz Hamzah, Surya Putra Mohamed Taulan, Hairulallias Shaari, and Ahmad Faiq Azizan.
Section 354 of the Penal Code provides for punishment of up to 10 years jail, a fine, whipping, or a combination of these. - Mkini
