High Court asks Najib, Azhar, Rashidi to file defence to SRC suit by Aug 30 | The Edge Markets
KL (Aug 3): High Court today instructed Najib and two former SRC directors Mohammed Azhar, Osman Khairuddin and Rashidi Che Omar to file defence to US$1.15 b suit by Aug 30
follows SRC statement of claim on Friday (July 30), after writ filed May 7 this year
- Najib found guilty by High Court on July 28 last year on seven counts of abuse of power in relation to (KWAP) RM4 billion loan in 2011 and 2012, and CBT and money laundering of RM42 million of SRC funds.
- For this Najib sentenced to 12 years' jail and fined RM210 million
- SRC 80-page statement of claim filed on Friday (July 30)
- According to statement of claim: abuse of power, dishonesty, misappropriation
- bulk of RM4b KWAP loans in 2011 and 2012 transferred overseas, not recovered
- US$120m gone into premier's account or placed under his control
- crucial documents linked to the fraud against SRC were destroyed
- SRC seeking declaration from Court for fraudulent breach of duties
- seeks order that they pay US$1.18b losses
My comments :
Again this is quite a pickle that these folks have gotten into. Tick tock, tick tock, tick . . .
There was so much excitement in the country yesterday. What a coincidence.
This is also why our legal system that allows convicted criminals freedom to move around pending their appeals should be re-looked. My suggestion is that we seriously relook our laws.
I have been repeating again and again and again that many of our laws are dinosaur, old fashioned and out of date.
Besides the law on allowing bail pending appeals for convicted criminals, the Sedition Act, our really foolish Libel Laws, that one particular section of the MCMC Act and our Religious Enactments must either be abolished or seriously rewritten.
If you ask me, if it is a serious crime then they should not be allowed bail - even while waiting for the appeals process.
What sort of serious crimes? I would include any type of violent crime and in case of fiduciary, white collar crimes where any amount above say RM500,000 is involved.
And if public funds are involved in the crime, then no bail at all - until the appeals process is exhausted.
Believe me - all these outdated laws will become election issues. The existence of these foolish laws or the non-amendment of them will increasingly become an election issue.
ALL FUTURE ASPIRANTS FOR MEMBER OF PARLIAMENT AND ADUN SEATS PLEASE TAKE NOTE. MAKE THESE AN ELECTION ISSUE AS WELL.
PART OF THE REASON OUR COUNTRY IS SUFFERING SO MANY PROBLEMS IS BECAUSE WE STILL HAVE THESE REALLY FOOLISH AND USELESS LAWS STILL IN SERVICE. GET RID OF THEM OR BELIEVE ME THE PEOPLE WILL GET RID OF YOU.
