Decision by Aug 28 to review Bersatu leader's Jana Wibawa charges

 


The attorney-general (AG) will decide by Aug 28 whether to review the multi-million ringgit corruption case against Segambut Bersatu deputy division chief Adam Radlan Adam Muhammad.

Deputy public prosecutor Mohamad Fadly Mohd Zamry told the Kuala Lumpur Sessions Court this today.

This followed a letter of representation sent by Adam Radlan to the AG on July 4 about the five corruption charges and seven money laundering counts linked to the Jana Wibawa programme.

Under the law, a letter of representation seeks for prosecutors to withdraw the criminal charges, or allow the accused to plead guilty to a lesser offence.

“We still have yet to get a final decision on the representation sent by the defence team.

“Today we have just received notification that the AG will make a final decision on Aug 28.

“I seek the discretion of this court to set another mention date for the representation,” Fadly told trial judge Suzana Hussin during the mention of the case this morning.

The prosecutor also applied for the postponement of the trial scheduled for tomorrow to allow the AG to peruse Adam’s representation.

The accused’s counsel Rajan Navaratnam said the defence team had no objection to the adjournment of the trial.

Suzana then vacated tomorrow’s trial and set Sept 4 for prosecutors to inform the criminal court of the AG’s decision.

Adam’s charges

In February last year, Adam claimed trial to a charge of soliciting a cash bribe of between 3.5 and seven percent of a RM47.8 million road construction project from Mat Jusoh Mamat, the managing director of MIE Infrastructure & Energy Sdn Bhd.

He was also charged with one count of accepting a RM500,000 bribe from the same individual as an inducement to help the firm secure the same project from the government through direct negotiations.

The project spanned from Jalan Sungai Adam to Kampung Banat in Perlis.

The offences were purportedly committed at a restaurant in Dutamas, Kuala Lumpur and the CIMB Bank Bukit Tunku branch in Taman Tunku, Kuala Lumpur on March 2021 and Nov 26, 2021.

Adam was charged with two counts of receiving RM4.1 million in bribes from one Lian Tan Chuan and Mat Jusoh to help Nepturis Sdn Bhd and MIE obtain two similar Jana Wibawa projects.

He also pleaded not guilty to one count of soliciting RM2 million from Lian as an inducement to help Nepturis secure a Jana Wibawa-related project.

All five graft charges were framed under Section 16(a)(A) of the MACC Act 2009 and punishable by a maximum 20-year jail term and a fine of at least five times the amount of the bribe or RM10,000, whichever is higher.

Adam also faces seven money laundering counts amounting to more than RM3 million under Section 4(1)(b) of the Anti-Money Laundering, Anti-Terrorist Financing, and Proceeds of Unlawful Activities Act 2001.

The prosecution was ready to call 47 witnesses to testify against the accused for the trial, which was initially set to begin on May 27. - Mkini
