KUALA LUMPUR: The sessions court today sentenced a 23-year-old man to six years in jail for committing unnatural sex with his then eight-year-old stepsister.
Judge Tasnim Abu Bakar handed down the sentence after the man pleaded guilty to the charge of committing carnal intercourse against the order of nature without consent.
He was charged with committing the offence at a flat in Jalan Sungai Baru, Kampung Baru, here, sometime in 2018.
He was charged under Section 377C of the Penal Code, which provides for a prison sentence of up to 20 years and whipping, if found guilty.
Tasnim ordered the man to serve the jail sentence from the date of his arrest on 15 Nov 2021, and to attend counselling while in prison.
Tasnim also ordered the man to be placed under police probation for two years after he is released from prison.
According to the facts of the case, in November 2021, the girl became quiet and cried after she was told by her mother that she should not allow anyone to touch her private parts.
The girl then told her mother what her brother had done and said she was afraid to tell anyone about it.
Meanwhile, during mitigation, the accused, who was unrepresented, said he had no permanent job and was supporting two siblings, aged 18 and 20, who were still studying.
Deputy public prosecutor Julaila Jamaludin requested a punishment reflecting the seriousness of the offence. - FMT
