Fahmi: 444 cases investigated under Section 233 of CMA since 2020

 


PARLIAMENT | A total of 444 cases have been investigated under Section 233 of the Communications and Multimedia Act 1998 from 2020 until Jan 23 this year. 

In a written parliamentary reply, Communications and Digital Minister Fahmi Fadzil said out of the 444, 38 cases were prosecuted in court. 

“Thirty-one cases (of the 38 cases) have been completed and were fined with a total value of RM284,000.

“Seven cases are currently still in the trial process,” he said. 

Fahmi (Pakatan Harapan-Lembah Pantai) was responding to Wan Saiful Wan Jan (Perikatan Nasional-Tasek Gelugor) who had asked how many social media accounts from various platforms have been investigated and why. 

Section 233 of the Communications and Multimedia Act stipulates offences of using network facilities to transmit communication deemed to be offensive or could cause annoyance to another person.

An offence under the section is punishable with up to one-year imprisonment, a fine up to RM50,000, or both, upon conviction.

Meanwhile, Fahmi (top picturesaid that two cases investigated by the Malaysian Communications and Multimedia Commission were awarded compounds with a total value of RM10,000. 

Another 43 cases were issued with a warning notice, he added. 

The minister said that of the total 444 cases, the platforms with the highest number of investigations were Facebook (158), Whatsapp (121), Twitter (36), Instagram (27), and Tiktok (23). - Mkini
