The Kuala Lumpur High Court moved the hearing date for the RM1.98 million 1MDB forfeiture suit against Yayasan Tun Hussein Onn from Nov 4 to Nov 15.
Judicial Commissioner Ahmad Shahrir Mohd Salleh allowed the application by the foundation's counsel Hariharan Tara Singh during open court proceedings this morning. DPP Mohd Farez Rahman did not raise an objection to the application.
The outcome was confirmed by Hariharan when contacted this morning.
"The previously set hearing date of Nov 4 has been moved to Nov 15 for the forfeiture suit hearing against Yayasan Tun Hussein Onn.
"I applied for the moving of the date in open court this morning. It is to allow parties to prepare better for the hearing," he said, adding that the court set Nov 13 for any filing of submission in reply.
In regards to the status of the letter of representation sent earlier to the Attorney-General's Chambers (AGC), Hariharan said the AGC is still going through it.
Under Malaysian legal procedure, a letter of representation is a method to seek possible ways to resolve and settle a case, such as allowing the authorities to forfeit a lesser amount in a forfeiture suit.
"The letter of representation is still pending (with the AGC). If the AGC accepts the letter of representation, this will be made known on Nov 15," the lawyer said.
On Sept 5, The Edge reported that Yayasan Tun Hussein Onn sent a letter of representation to the AGC.
Established by a parliament act in 2017, the Yayasan Tun Hussein Onn is a government foundation under the Education Ministry that replaces the Teachers’ Provident Fund.
Its main aims are to ensure the welfare and the professional development of teachers.
Jan 17 for hearing of RM11.38m 1MDB forfeiture suit against Jakel Trading
Meanwhile, a separate Kuala Lumpur High Court fixed Jan 17 next year for the hearing of the RM11.38 million 1MDB forfeiture suit against Jakel Trading.
This was revealed by senior assistant registrar Farah Azura Mohd Saad, who conducted the case management of the matter today.
Jakel Trading and Jakel Trading Sdn Bhd are well-known textile wholesalers and distributors.
According to the company website, it provides “apparel for employees of government sectors”. It also has business interests in property development and shopping malls.
Yayasan Tun Hussein Onn and Jakel Trading are among the 41 local groups, companies and individuals targeted in an MACC civil suit that seeks the forfeiture of RM270 million allegedly originated from 1MDB. - Mkini
