The Kuala Lumpur High Court has fixed Nov 28 for case management to allow former premier Najib Abdul Razak and his lawyer Muhammad Shafee Abdullah to file further affidavits in their bids to oust Gopal Sri Ram from prosecuting the duo's criminal cases.
This was confirmed by Senior Federal Counsel Shamsul Bolhassan, who represented former federal court judge Sri Ram (above), during case management in the chambers of judge Mariana Yahya today.
"(The court) Set Nov 28 for next case management to allow the parties to put in affidavits for both cases (Najib and Shafee's separate judicial review applications to disqualify Sri Ram as lead DPP in the duo's cases)," Shamsul said, adding this is also to allow parties to reply to each other's affidavits if need be.
He was speaking to reporters after the proceedings.
Counsel Sarah Malini Abishegam, who appeared for Najib and Shafee (below) , confirmed the outcome of today's chamber matter.
She added that the court sought the new case management date to allow parties to prepare for the hearing by exchanging and replying to each other's affidavits.
Neither Najib, Shafee, nor Sri Ram was present at proceedings today.
Previously, it was reported that the court set today for hearing of the matter.
On Aug 7, the Federal Court upheld the ruling of both the Court of Appeal and the Kuala Lumpur High Court in dismissing Najib’s legal bid at the criminal court jurisdiction level to remove Sri Ram as DPP.
However, on Aug 26, the Court of Appeal allowed separate appeals in the civil court jurisdiction level by Najib and Shafee to be granted leave to proceed with their judicial review bids to challenge the legality of Sri Ram’s appointment as DPP.
On Oct 15, the Federal Court upheld the Court of Appeal verdict and ordered Najib and Shafee's civil court level legal challenge be heard at the High Court.
Sri Ram is currently the lead DPP in Najib's ongoing RM2.28 billion 1MDB trial and Shafee's RM9.5 million money laundering case, among others. - Mkini
