Prosecution withdraws appeal against stay of Peter Anthony’s conviction

PETALING JAYA: The High Court here has struck out the prosecution’s appeal from a sessions court decision granting former Sabah infrastructure development minister Peter Anthony a stay of his conviction and sentence for using falsified documents.

Justice Zaini Mazlan issued the order after deputy public prosecutor Haresh Prakash Somiah informed the court that the prosecution had withdrawn its appeal on Oct 28, according to Bernama.

Peter, 51, who is also a Melalap assemblyman, was represented at the case management proceedings by lawyer S Devanandan.

He had filed the stay application to enable him to contest in the 15th general election.

On Aug 1, sessions court judge Azura Alwi allowed his application.

However, on Nov 5, the Election Commission rejected Peter’s nomination papers to contest the Tenom parliamentary seat.

Azura had on May 26 sentenced Peter to three years’ jail and a fine of RM50,000, in default 15 months’ jail, after finding him guilty of forging a letter for system maintenance work at Universiti Malaysia Sabah in 2014.

His appeal will be heard by the High Court on Jan 27. - FMT
