Parliament or State Assembly Speaker advises Election Commission on Seat vacancy.

The Election Commission is an administrative body that conducts and oversea State, National  and by-elections and which should be conducted as per the election laws.

On the advice of the Parliament Speaker or State Assembly Speaker, the Election Commission will declare that particular seat vacant.

Bear in mind, the Election Commission on its own has no inherent powers to declare any seat vacant without the advice from the Parliament Speaker or State  Assembly Speaker.

So, why does the ex- Election Official want to confuse the rakyat with this uncalled for statement.

In the case of Selangor, the State Assembly is in the mist of dissolution or its term is coming almost to the end, and the law is that no elections need to be called.
