PETALING JAYA: The Malaysian Aviation Commission (Mavcom) has said it will not get involved in the ongoing war of words between Malaysia Airports Holdings Bhd (MAHB) and AirAsia Group Bhd over the collection of the passenger service charge (PSC) at the Kuala Lumpur International Airport 2 (klia2).
Mavcom chairman Nungsari Ahmad Radhi said they will wait for the courts to make a decision on the matter.
“This is a commercial dispute between two parties. It is the court which will decide the next course of action and this may include Mavcom.
“So, (it’s) best (to) wait for the court’s decision,” he told The Malaysian Reserve on Monday.
Mavcom is authorised to adjudicate any dispute between two or more aviation service providers.
However, according to the Mavcom Act 2015, if the case is already in a court of law, the parties can choose either method to solve the matter, but not both.
AirAsia last week said MAHB had dismissed a Mavcom offer to mediate the dispute between the two entities.
The two parties have been embroiled in a war of words after MAHB sued AirAsia and its long-haul affiliate, AirAsia X Berhad, over outstanding taxes.
The airline counter-sued MAHB for more than RM400 million for losses and damages due to operational disruptions at klia2.
The low-cost airline has been insisting that facilities at klia2 are inferior when compared to the main terminal and, therefore, it was not justified to impose the same passenger charges.
AirAsia was involved in another heated exchange yesterday after the MAHB served a letter of demand on AirAsia demanding that it pull down all the publications critical of the airport operator.
In response, AirAsia said MAHB was using its dominant position to threaten legal action against it.
The airline said it stood by everything it had published on its website, AirAsia Newsroom, and maintained that MAHB’s threat of legal action was unwarranted. -FMT
