Inspector-General of Police Mohamad Fuzi Harun clarified that it is the Attorney-General's Chambers (AGC) which decides on whether a person should be charged or otherwise.
“The people must understand the legal process, it is not all up to us (the police).
“We investigate, but we do not press charges, we rely on the deputy public prosecutors for further instructions and we will adhere to whatever instructions they give us.
“I hope everybody understands this,” he said when asked during a press conference after the Federal Reserve Unit’s 63rd-anniversary celebrations in Cheras today.
Fuzi was commenting on the decision to release a senior citizen, who was detained over a Facebook post deemed insulting to Prophet Muhammad, on police bail.
The decision to free the 68-year-old suspect drew criticisms from various quarters while PAS and Umno have warned that a mammoth gathering would be held, should the AGC fail to take swift action against him.
Elaborating, Fuzi said the police should not be blamed for this.
"It's not our fault, many do not understand and say we are in charge of everything. It’s not us,” he added.
Fuzi said the police had applied for a 10-day remand order for the suspect, but the Magistrate's Court only granted three days.
“We asked for the remand to be extended, but it was not approved as the suspect had health complications of the heart, high blood pressure and other things.
“The court turned down our (remand) request and that is why we released him on police bail,” he added. - Mkini
