Court sets Nov 29 to hear Rosmah's bid to inspect assets



The Kuala Lumpur High Court fixed Nov 29 to hear Rosmah Mansor's application for photos and to inspect the assets sought to be seized in the RM680 million forfeiture suit against Obyu Holdings Bhd.
Judge Collin Lawrence Sequerah fixed the hearing date during the case management of the application by the former prime minister Najib Abdul Razak’s wife in open court today.
Sequerah ordered the parties to file all related affidavits at least a week before the hearing date on Nov 29.
This was confirmed by Rosmah’s (photo) counsel Iskandar Shah Ibrahim when met after proceedings.

“We wish to conduct a physical inspection for identification (of assets sought to be forfeited in the legal action against Obyu Holdings),” the lawyer said.
Back on Sept 3 through their respective lawyers, Najib, Rosmah, their two children, Umno and Lebanese jeweller Global Royalty Trading SAL announced their intent to stake their claims in the assets being sought in the 1MDB forfeiture suit against Obyu Holdings.
Global Royalty Trading is suing Rosmah in a separate US$14.79 million (RM59.831 million) legal action for the return of jewellery seized from the Pavilion Residences units in a raid by the police following the 14th General Elections last year.
Earlier during proceedings today, Sequerah also dismissed the prosecution’s preliminary objection against Rosmah’s entry as a third party seeking to stake her claim in the suit against Obyu Holdings.
The judge ruled that it was sufficient for Rosmah’s lawyer informing the court on Sept 3 in relation to her intent to stake her claim as a third party in the suit against Obyu Holdings.
The court had earlier allowed the prosecution’s application to gazette that date (Sept 3) for third parties, whether by themselves or through their lawyers, to come to court and announce their intent to stake their claims in the legal action.
In dismissing the prosecution’s preliminary objection, Sequerah noted that the provisions of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLATFPUA) does not state a specific procedure on how third parties can announce their intent to stake their claims.
DPP Fatnin Yusof had earlier raised the prosecution’s preliminary objection on the grounds that Rosmah needed to file an affidavit in relation to her intent to stake her claim.
Iskandar had countered that Rosmah, through her lawyers, had already registered their client’s interest back on Sept 3, therefore there is no need for them to file an affidavit to that effect.
“There is no prescribed (specific) procedure (under AMLATPUA) for the third party to register their interest (by filing an affidavit to that effect among others),” Sequerah said in dismissing the preliminary objection.
The third-party claims by Najib, Rosmah, Umno, and Global Royalty Trading would come up for hearing before Sequerah on Oct 31. - mkini
