The Liberal Democratic Party (LDP) will keep RM500,000 while surrendering RM9,560.96 to the government as part of the settlement of the 1MDB forfeiture suit against the Sabah-based political party.
This was the consent judgement recorded by Kuala Lumpur High Court judge Collin Lawrence Sequerah (photo) during case management of the legal action today.
LDP’s counsel Jagjit Singh and MACC DPP Nik Haslinie Hashim attended the open-court proceedings.
Jagjit said the settlement came on the heels of LDP having earlier sent a letter of representation to the prosecution as part of an attempt to settle the RM509,560.96 amount stated in the legal action against the political organisation.
“Order in terms (was issued by Sequerah in the settlement of the suit), only RM9,560.96 was forfeited.
“The balance of RM500,000 is to be returned to LDP Sabah plus interests,” Jagjit said, adding that the overall terms of settlement remained private and confidential and were not revealed during the proceedings.
According to a copy of the draft court order dated today (Oct 18), the prosecution and LDP agreed that the RM9,560.96 in a Maybank current account be forfeited to the Malaysian government.
“The applicant (prosecution) will lift (membatalkan) the Property Seizure (Penyitaan) Order dated June 29, 2018, on the account after the money (RM9,560.96) is received by the government of Malaysia,” it read.
When met after the proceedings, LDP president Chin Su Phin expressed satisfaction at the outcome of the matter as not only the freeze over the party’s bank account would be lifted but also that RM500,000 was returned.
“We are quite happy that the Attorney-General has accepted (LDP’s letter of representation) through the forfeiture of the RM9,560.96 and our (LDP bank) account would be unfrozen.
“The RM500,000 is not related to 1MDB,” he said. He, however, declined to speak further about the matter.
On June 21, the MACC filed civil forfeiture suits worth RM270 million against 41 local individuals and groups. LDP is one of the respondents.
Since then, a few of the suits have been settled, such as the legal action against Yayasan Rahah and Pekan Umno education bureau chairperson Ibrahim Awang Ismail.
Among the legal action’s respondents reported being in the midst of trying to resolve the matter is Sarawak businessperson Bustari Yusuf, a close associate of former prime minister Najib Abdul Razak. - Mkini
