Former Felda chairperson Isa Abdul Samad will file a letter of representation to the Attorney-General’s Chambers in relation to his RM3 million case of corruption and criminal breach of trust.
Counsel Salehuddin Saidin informed judge Mohd Nazlan Mohd Ghazali about his client’s plans during case mention at the Kuala Lumpur High Court today.
“We will file (send) the representation to the Attorney-General’s Chambers. Today we will file it,” the lawyer told the court during proceedings.
A letter of representation is a method that may be utilised by an accused person to seek either the reduction or dropping of the criminal charge.
Nazlan then reminded Salehuddin that any new development in the letter of representation must be relayed to the court.
“In regard to the (letter of) representation, if there is any development, (you) must write to the court,” Nazlan said.
The judge then set Sept 23 for mention to update the court on the status of the letter of representation to the AGC.
DPP Afzainizam Abdul Aziz appeared for the prosecution in today’s matter, which concerned the exchange of documents.
During the open court proceedings, Salehuddin informed the court that he is now officially the counsel on record for Isa, taking over from the accused’s previous counsel K Kumaraendran and Ridha Abdah Subri.
On April 11, it was reported that the High Court set 13 days to hear Isa’s case, starting on Oct 7.
The former Felda chair is facing one count of criminal breach of trust and nine counts of receiving gratification totalling more than RM3 million.
Isa, 70, maintained his not guilty plea on all charges.
He was alleged to have committed criminal breach of trust by approving a proposal for the purchase of Merdeka Palace Hotel & Suites in Kuching, Sarawak, for RM160 million, without approval from Felda’s board of directors.
Isa is accused of committing the offence in Menara Felda on April 29, 2014.
The criminal breach of trust charge is laid out under Section 409 of the Penal Code, which specifies for maximum imprisonment of 20 years, whipping and a fine, on conviction.
Regarding the graft charges, Isa allegedly received gratification in cash totalling RM3,090,000, from Ikhwan Zaidel, who is a board member of Gegasan Abadi Properties Sdn Bhd, through one Muhammad Zahid Md Arip.
Isa allegedly received the gratification for helping to approve the purchase of the Merdeka Palace Hotel Suites by FIC Sdn Bhd for RM160 million.
All the offences were allegedly committed at Menara Felda between July 21, 2014, and Dec 11, 2015. - Mkini
