Former attorney-general Abdul Gani Patail and the government have applied to strike out a suit filed by Selangor exco member Nik Nazmi Nik Ahmad, in relation to attempts to charge him under the Peaceful Assembly Act 2012.
Gani and the government's lawyers submitted that Nik Nazmi's suit was an abuse of the court process, frivolous and vexatious.
Senior federal counsels Zureen Elina Mohd Dom and Kamal Azira Hassan told this to the court during a pre-trial proceeding before Justice Ahmad Zaidi Ibrahim. Syahredzan Johan appeared for Nik Nazmi.
It is understood that the striking out application was filed after Nik Nazmi pleaded guilty to not providing ample notice for the "Black 505" rally held in 2013 and was fined RM1,500 last December.
It was reported that Nik Nazmi, 35, filed the lawsuit against Gani on March 31, 2015, alleging that the then attorney-general's decision to prosecute him again, despite having the initial charge being thrown out, was malicious.
The plaintiff was charged at the Petaling Jaya Sessions Court for the second time on May 6, 2014. He was charged a third time for the same offence in 2016.-Mkini
