High Court to hear Marzuki's by-election result petition


Senator Marzuki Yahya's election petition on the results of the Tasek Gelugor by-election will be finally be heard by the High Court.
"I feel encouraged by the High Court’s decision today to hear my case," Marzuki, the Tasek Gelugor Bersatu candidate told Malaysiakini.
"I have been waiting for this since the results of the 14th national polls (GE14) came out. Let the truth be told, let justice be served," he added.
He was referring to the Penang High Court's decision today to hear his election petition to contest the results of the Tasek Gelugor parliamentary seat.
The case had been postponed following the Election Commission's delay in finding a counsel.
After GE14, the EC's privy to a government counsel was removed by the Attorney-General's Chambers to maintain the neutrality of the commission.
Since the EC has appointed a lawyer, Marzuki's petition will now be heard on Aug 15.
In the May 9 polls, the Penang Bersatu chief lost the seat to BN’s incumbent MP Shabudin Yahaya, who won with a wafer-thin majority of 81 votes.
This prompted Marzuki to file an election petition to recount the 689 spoilt votes and 297 unreturned (postal) votes.
In the polls, Shabudin obtained 18,547 votes, Marzuki garnered 18,466 while PAS’ Rizal Hafiz Ruslan secured 14,891 votes.
Marzuki’s lawyer Mohamad Rafique Rashid Ali told reporters that judge Hashim Hamzah made the decision in chambers today.
"The hearing will hear preliminary objections by both parties, including that of Tasek Gelugor MP Shahbudin Yahaya," Rafiq said outside the court.
“Substantive issues related to the petition will be heard while both parties settle the objections raised with all respondents,” Rafiq added.
Lawyers Rafiq and Azlina Mehtab Mohd Ishaq are representing Marzuki. Shabudin is represented by Simon Tan and Cynthia Loo, while the EC is represented by Sathya Kumardas. - Mkini
