Anwar Ibrahim’s political aide Farhash Wafa Salvador Rizal Mubarak has filed an application to expunge parts of a suit against him (Farhash) by Muhammad Yusoff Rawther, on grounds that they were alleged political stunt and an abuse of court process for political gain.
Farhash (above), who is also Perak PKR chief and a member of the party’s central committee, filed the application through legal firm Messrs Azwar & Partners at the Shah Alam Sessions Court Registry on Oct 25 last year.
His notice of application stated that he seeks to remove nine paragraphs from former research assistant Yusoff’s statement of claim, which formed part of a suit filed by Yusoff against Farhash in September last year.
Alongside Farhash, PKR president Anwar’s press secretary Tunku Nashrul Tunku Abaidah is also being sued by Yusoff over an alleged brawl at Anwar’s office at Bukit Gasing in May last year.
According to a copy of the application’s affidavit in support sighted by Malaysiakini today, Farhash claimed that the impugned paragraphs were an abuse of court process for not only being irrelevant to the main suit, but also amounting to political stunt and politically motivated.
“I believe that the statements in the paragraphs are only the plaintiff’s (Yusoff) political stunt by using and/or saying and/or linking the name and reputation of DSAI (Datuk Seri Anwar Ibrahim) as a well-known politician in Malaysia,” he said in the affidavit signed by him.
Farhash claimed that it is not proper for Yusoff (photo) to include the paragraphs as Anwar is not involved in the alleged incident and has nothing to do at all with the suit.
“I state that the politically-motivated paragraphs have caused widespread media coverage online that have unnecessarily affected DSAI’s image and name.
“I verily believe that at the same time that the plaintiff’s (Yusoff) statement in the paragraphs have triggered electronic media coverage to give political gain to the plaintiff by painting that there had been chaos in DSAI’s office and to paint the plaintiff as a victim.
“That by linking DSAI’s name among others have the intent to trivialise and sensationalise an issue that has nothing to do with the plaintiff’s cause of action against the defendant,” he said.
Farhash also alleged that the impugned paragraphs should be removed as they positively do not show any direct correlation with Yusoff’s suit against him.
“I humbly believe that the paragraphs have nothing clearly to do with the plaintiff’s case, what more it is not pleaded in the relief (sought by Yusoff in the suit against Farhash)," he said.
Meanwhile, through a message today, Yusoff’s lawyer Mohamed Haniff Khatri Abdulla confirmed that the application was filed by Farhash.
Yusoff, who claimed to have at one point been Anwar's research assistant, came into the limelight last year, through the allegation of him being physically assaulted at Anwar’s office, and through a Dec 3 press conference where he claimed to have been sexually assaulted by Anwar.
On Jan 14 this year, the Attorney-General’s Chambers announced that no charges would be levelled against Anwar due to lack of evidence.
On Jan 24, Farhash filed a defamation suit against Yusoff in relation to the Dec 3 press conference. - Mkini
