Bankruptcy proceedings may be initiated against Perak PAS commissioner Razman Zakaria for failing to pay damages in relation to a defamation suit within the stipulated period.
The Gunong Semanggol assemblyperson must pay a sum of RM200,000 to Perak Amanah deputy chairperson Mohammad Nizar Jamaluddin.
This was after Razman (above) was found liable for slandering the former Perak menteri besar in an article published in the Malay language daily Sinar Harian on June 2, 2015.
The article was titled “Pendekatan Nizar Mirip DAP (Nizar's approach resembles DAP's).”
Nizar's lawyer Mohd Fitri Asmuni told Malaysiakini that no payment has been made to his client until now.
“The total amount which Razman needs to pay is RM254,150. This includes costs and interests.
“We had sent a letter to his lawyer, asking Razman to settle the sum latest by Jan 29. But my records show that he has not paid as yet.
“After discussing with my client, InsyaAllah (God willing), we will initiate bankruptcy proceedings against Razman,” he added.
Last November, the Court of Appeal upheld the Ipoh High Court's decision to order Razman to pay Nizar (photo) RM200,000 in damages over the article.
A three-member bench comprising Justices Badariah Sahamid, Hasnah Mohammed Hashim and Harmindar Singh Dhaliwal, in a unanimous decision, had dismissed Razman's appeal.
Justice Badariah, who chaired the bench, said the court found no merit in the appeal, adding that there was no error in the High Court judge's findings which warranted the appellate court's intervention.
She also ordered Razman to pay costs of RM10,000 to Nizar.
Nizar filed a RM3 million suit against Razman in 2016, claiming the latter's statement was defamatory and had tarnished his image as a politician. - Mkini
