TAWAU: Two Lahad Datu Vocational College students said in the High Court here today they saw a student being beaten in a college hostel room on the night of March 21.
The prosecution witnesses said they did not report the incident to the hostel warden for fear of being beaten like the victim, Nazmie Aizzat Narul Azwan.
During examination-in-chief by deputy public prosecutor Batrisyia Khusri, one of them told the court that Nazmie Aizzat was beaten by six of the accused in Room 7, or Resak.
“The first accused punched Ijat (Nazmie Aizzat) in the stomach. Ijat bent down to protect himself and appeared to be holding back the pain,” he said.
Thirteen students, aged between 16 and 19, are charged with jointly murdering Nazmie Aizzat, 17, in Room 7 and Room 5 (Belian) at the college between 9pm on March 21 and 7.39am on March 22.
The charge, framed under Section 302 of the Penal Code read together with Section 34 of the same code, carries the death penalty or imprisonment for 30 to 40 years and not more than 12 strokes of the cane, upon conviction.
“They asked about the money belonging to the third and fourth accused, and I heard Ijat admit to taking it. He then handed over RM50 and RM20, but as he was doing so, the first accused suddenly punched him in the stomach,” the witness said.
The other witness told the court he saw one of the accused punch Nazmie Aizzat in the face, while another shoved him into a locker in Room 7.
The hearing before Justice Duncan Sikodol continues tomorrow. - FMT
