Ex-Klang MP goes to court to stop 15th general election

 

KUALA LUMPUR: Former Klang MP Charles Santiago has gone to the court to stop the Election Commission from conducting the 15th edition of the polls as caretaker prime minister is said to have breached provision in the Federal Constitution.

Santiago, who filed an originating summons at the High Court here yesterday, named Ismail Sabri Yaakob, the government and the EC as respondents.

He wanted a declaration that the request by Ismail to the Yang di Pertuan Agong for Parliament to be dissolved was in contravention of Article 40(1) and (1A) of the Federal Constitution.

Santiago said the request was not made on the advice of the Cabinet and therefore null and void.

On Monday, Ismail announced that Parliament had been dissolved, paving the way for the general election.

This means the nation will go to the polls within 60 days.

“In line with Article 40(2)(b) and Article 55(2) of the Federal Constitution, the Yang di-Pertuan Agong has approved my request to dissolve Parliament today, Monday, Oct 10, 2022,” Ismail said in a special address.
