My comments : First of all congratulations to the Ahmadiyah community for winning this really stupid and time wasting case. Once again it proves that even in the 21st centruy the Muslims really have nothing much to do in their lives. They waste time on these trivial and useless matters.
Congratulations to the Shah Alam High Court and to Justice Datuk Vazeer Alam Meera Mydin for his wisdom. Does it always need a mamak to make such wise decisions?
The comments by the Mufti of Penang are devious and not original.
In Pakistan the Ahmadiyahs have suffered the same issues - the Sunnis in Pakistan refused Ahmadiyah members from burying their dead in the cemeteries. By this act they were saying the the cemetery was exclusively Sunni.
This is what the Mufti of Penang is also saying.
The statement (as reported in the Press) by the Judge Justice Datuk Vazeer Alam Meera Mydin does not touch on whether the Ahmadiyah are Muslims or not. I dont think the Court is that stupid to play "god".
Justice Vazeer merely referred the 2001 fatwa by the JAIS. Just because JAIS had already declared the Ahmadiyah apostate, that does not mean they are really apostate. It is merely JAIS' opinion. JAIS is not "god".
For those of you tak-cukup-oksigen-mengalir-ke-dalam-otak types let me give you another example. In Malaysia the Shias can be are arrested on sight. Just declare you are a Shiah and the religious guys can arrest you on sight. This means Shia are apostates - quite instantly.
But the Sharifs of the Haramain (ie The Guardian Of Islam's Two Holiest Cities) allows the Shias to perform the pilgrimage to Mecca. In Mecca, Shias are considered Muslims.
So are the Ahmadiyah. The Ahmadiyah are also allowed by the Sharif of Haramain to perform the pilgrimage to Mecca.
In Mecca the Ahmadiyah, Shias can pray in the Masjid Al Haram.
They say Assalamualaikum to everyone.
Their food is halal.
You can marry their women. (Yang itu ok-lah kut)
Only in Malaysia (and Pakistan) there seems to be confusion.
Even in Indonesia the Ahmadiyah have been around for a long time.
The Indonesian government has no issues with them.
Only in Malaysia it is different.
JAIS can say that Ahmadiyah are not Muslims - but that is just JAIS own opinion.
JAIS and the Penang Mufti's views are not a worldwide, universal opinion that is recognised by other Muslim countries or the Sharifs of the Haramain for the past 1000 years.
Which is why the Shah Alam High Court did not say that the Ahmadiyah were not Muslims. It merely tells the JAIS that since "you" say they are not Muslims, then you have no more jurusdiction over them. It does not actually mean that Ahmadiyah are not Muslims.
As far as burying the dead is concerned everyone knows that burying the dead is almost always part of religious activities.
Justice Vazeer said : "Jais no right to stop religious activities of Ahmadiah"
It goes without saying that the Ahmadiyah's cannot be prevented from burying their dead in Muslim cemeteries.
Akhirul Kalam : I have a question for the Muslims. For how many more centuries are you going to be door-knob dumb like this? Fighting over who is closer to "god", who is on the right path, I am right, you are wrong - like childish illiterates.
Know that religion has ZERO evidence for whatever it says.
Religion is just faith.
It is your faith versus the other person's faith.
No proofs are required.
Let me correct myself : No proofs are available.
There is no proof for whatever you say.
Religion is just blind faith.
Minus solid proof, minus scientific evidence, it is just your "faith" versus the other fellows "faith". So chill ok.
In the world today the Muslims are flourishing to the maximum in the non Islamic countries.
If you go to Singapore you should visit their Choa Chu Kang Cemetery complex. It is a huge burial area for all religions. My wife's uncle (their family are largely Singaporean) is buried at Chua Chu Kang and I attended his burial. The Muslims on one side, the Christians closeby, the Hindus nearby, the Buddhists, Taoists all nearby. It is a fantastic place. You can actually stop there for a picnic - so green and beautiful and quiet.

As long as you are a human being, you can be buried there.
Muslims prosper best in the non Muslim countries like the US, UK, Australia, Singapore, France, Germany and other such countries.
Because in these non Muslim countries the Muslims are forced to obey the law of the land. Hence they immediately become more civilised. One Muslim cannot attack another Muslim simply because the other is a Shia, Sunni, Ahmadiyah or whatever.
Hence ONLY and ONLY in the non Muslim countries do ALL Muslims (Shia, Sunni, Ahmadiyah, Tablighi, Soofi etc) live in peace beside each other. This is a fantastic phenomenon.
It means that the Muslims can live side by side with fellow Muslims, including in Malaysia.
The only exceptions could be Selangor, Penang etc etc.
