The apex court will have to study submissions from both sides before making a ruling on an appeal by Raub Australian Gold Mining (RAGM) concerning a defamation suit previously won by Bukit Koman resident and activist Hue Shieh Lee.
Federal Court justice Ramly Ali, who led the five-member panel, came to this decision after listening to submissions from both sides for three hours.
The other justices are Balia Yusof Wahi, Azahar Mohamed, Rohana Yusuf and Mohd Zawawi Salleh.
RAGM was represented by Cecil Abraham, while Hue was represented by Gurdial Singh Nijar.
RAGM filed a defamation suit against Hue in 2013. She was among several activists who were campaigning against the firm's gold mine in Bukit Koman, Pahang, which purportedly used cyanide as part of the gold extraction process.
The High Court in Kuala Lumpur ruled against RAGM in May last year, and the Court of Appeal dismissed the gold mine's appeal five months later. RAGM then filed an appeal to the Federal Court.
The gold mining firm had also filed a defamation suit against Malaysiakini, which was dismissed by the High Court in May 2016.
However, the Court of Appeal reversed the judgment and ordered Malaysiakini to pay a sum of RM200,000 in damages and RM150,000 in legal costs to RAGM.
Malaysiakini has since been granted leave to challenge the Court of Appeal's decision. - Mkini
