Court sets dates for MACC to notify 9 respondents in 1MDB suits



The MACC's application to notify nine of the 41 respondents to contest its civil forfeiture suit to recoup over RM216 million in 1MDB-linked funds will be heard on July 12, 19 and 26.
According to deputy public prosecutor Nik Haslinie Hashim, High Court deputy registrar Mahyudin Mohd Som fixed the dates following case management this morning.
Mahyudin later confirmed that lawyers for six respondents were present in court, while three others were absent.
"Today we have nine files. The dates have been set to hear applications (from MACC) to issue third-party notices according to Section 61(2) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001," he told reporters when met in his chambers.
Section 61(2) of the act states that the court making the order of forfeiture under Section 55, or the judge to whom an application is made under subsection 56(1), shall publish a notice in the Gazette calling upon any third party claiming to have an interest in the property to appear in court.
This provision allows respondents to show cause as to why their listed properties should not be forfeited.
The six respondents present today were Naza Quest Auto Sdn Bhd, Yayasan Rahah, Ibrahim Awang Ismail, Pekan Umno, Habib Jewel Sdn Bhd, and Johor Bahru BN.
Naza Quest Auto was represented by lawyer Md Yunos Shariff (photo), while Amin Othman acted for Yayasan Rahah and Ibrahim, Amalin Mohd Zahid for Pekan Umno, Gooi Yong Shuh for Habib Jewels, and Johor BN treasurer Jais Sarday for Johor Bahru BN.
Of the nine respondents, Mahyudin fixed July 12 for High Court judge Mohd Nazlan Mohd Ghazali to hear the notice application for Ismail, Kedah Umno, Pekan Umno, SUPP, Yayasan Rahah and Habib Jewels.
Subsequently, Nazlan will hear the notice applications for Johor Bahru BN on July 19 and Naza Quest Auto on July 26.
Last Tuesday, Kuala Lumpur High Court judge Mohamed Zaini Mazlan allowed an application by deputy public prosecutor Kamal Baharin Omar to gazette and issue the same notice to Umno and six other respondents.
On June 21, new MACC chief commissioner Latheefa Koya announced that forfeiture suits had been filed against Umno and 40 other entities to recover over RM270 million in funds linked to 1MDB.
Of that amount, over RM 212 million is being sought from Umno alone. - Mkini
