Rafizi to lodge disciplinary complaint against Rizal, mulls filing suit



PKR vice-president Rafizi Ramli will be lodging a disciplinary complaint against Rizal Mansor, the aide to Prime Minister Najib Abdul Razak's wife Rosmah Mansor, for violating regulations imposed on civil servants.
Rafizi said he will be lodging the complaint next week as Rizal has continued to "dabble in petty political work".
As a Prime Minister's Office Special Division principal assistant director, Rafizi said Rizal has violated Rule 21(1) of the Public Officers Regulations (Conduct and Discipline) 1993 which prohibits civil servants from taking part in politics after he continued to come out with political statements which include "attacking Rafizi and Invoke", the Pandan lawmaker's policy research body.
This, after Rizal accused Rafizi of using public donations channeled to Invoke through another company also owned by the latter.
Apart from lodging an official complaint against Rizal, Rafizi said he will also be discussing with his lawyers about filing a suit against Rizal over his "slander".
"Even though I have never sued anyone previously, even (blogger) Papagomo, I feel Rizal has the money and financial support (to face the suit).
"Unlike suing Papagomo who doesn't have anything and wouldn't be able to pay his lawyers even if he wins, I believe Invoke will get hundreds of thousands of ringgit in compensation if I file a suit against Rizal," he added.
In a statement today, Rafizi also explained the reason behind not registering Invoke with the Registrar of Societies (ROS).
"Taking into account the risk that Invoke won't get the ROS' approval, I decided to form Invoke as a private company owned 99 percent by me."
On quarters who say that there is a conflict of interest element in using a private company to obtain the people's support, Rafizi claimed he does not receive any benefit from Invoke.
"I don't receive a single sen from Invoke or from other companies I own such as KEIP Resources Sdn Bhd," he said, adding how he had injected his own savings into Invoke.
Invoke workers have contracts with KEIP Resources which has a human resource agreement with Invoke.
Rizal yesterday said that a search under the Companies Commission of Malaysia (CCM) found Rafizi is also the largest shareholder of KEIP Resources.
“This means that Rafizi provides human resource for Rafizi and paid Rafizi hundreds of thousands a month on the pretext of providing human resource from money collected by the people," Rizal had said.
Rafizi, however, said although Invoke and KEIP Resources are owned by the same person, the two are different entities.
All Invoke employees, however, are also employees of KEIP Resources, he explained.
"If the authorities want to take action against Invoke, they cannot drag the staff as they are only subcontractors doing their job according to the terms of the contract agreed between KEIP Resources and Invoke.
"In this way, I am trying my best to protect the young people in Invoke from becoming victims if Invoke gets attacked."

Employing such methods will also reduce the risk of Invoke employees not receiving their salaries should Invoke get sued.
"Separating legal entities is a normal procedure practiced by major companies in the world. So it doesn't arise about me forming a company to obtain financial benefits from Invoke.
"If Rizal knows a little bit about management practices, he would have known about this," added Rafizi.
