Lorry driver gets five years' jail for breaking into judge’s house



A 22-year-old assistant lorry driver was sentenced to five years’ jail at the Sessions Court in Kuala Lumpur today for breaking into a Federal Court judge’s home and stealing several items worth an estimated RM11,300.
Ahmad Norfais Ishak pleaded guilty to breaking into Justice Balia Yusof Wahi's house in Jalan Kent, Wangsa Maju, via the toilet window, and stealing two Nikon cameras, three Porsche model cars, a Go Pro camera, a power bank with a Palace of Justice label, a lens kit for a mobile phone, a mobile hard disk, a pair of shoes, and a government issue HP laptop.
The crime occurred at about 6.10am on Oct 22, 2017.
Ahmad Norfais was charged under Section 457 of the Penal Code, and was sentenced to the minimum five-year jail sentence.
He was arrested the next day after surrendering himself at the Sungai Buloh police station.
After police compared Ahmad Norfais' fingerprints to those found at the scene, he then led them to several locations to recover the stolen goods.
Legal Aid Centre lawyer Ernie Ahmad, who appeared for the accused, said during mitigation that he had cooperated with the police by surrendering himself a day after the incident, which led to the recovery of the items, except stolen cash.
She asked the court to utilise its discretion to bound over the accused under Section 294 of the Criminal Procedure Code, as he had a family to support.
“He only earns RM1,100 and is married with three children. He vouched he would not repeat such an offence. There is no element of violence in this case,” Ernie said.
Deputy public prosecutor Nurakmal Farhan Aziz said a bound over sentence would not be suitable due to the gravity of the crime.
“A break-in is a serious crime and the court should give a deterrent sentence to send the right message to the people,” he said.
Sessions judge Shamsudin Abdullah ordered that Ahmad Norfais serve five years in jail from the date of his arrest on Oct 23.- Mkini
