Court allows exhumation of Cradle CEO's remains


The Court of Appeal has allowed the exhumation of the remains of Cradle Fund Sdn Bhd CEO Nazrin Hassan in light of new evidence regarding his death.
This came after the court dismissed a motion from the deceased's second wife, Samirah Muzaffar, to vary the order issued by the High Court in Shah Alam last Thursday.
Justice Mohtaruddin Baki, who led the three-member bench, said: "There is no merit in the motion."
Police forensic team personnel are already at the Kota Damansara cemetery to carry out the exhumation process following the court decision.
Earlier, Samirah also failed to get a stay on the order from the High Court in Shah Alam.
Samirah's lawyer M Puravalen told the court the family wanted retired pathologist Dr Bhupinder Singh to be present during the exhumation and the second post-mortem. 
Puravalen said his client was not objecting to the exhumation, but a variation of the order, for which she was seeking leave from the Court of Appeal.
Deputy public prosecutor Jamil Aripin later said that although a family member could be present at the exhumation, Bhupinder's presence would require the approval of the pathologist conducting the second post-mortem.
Nazrin died at his home in June. At the time, he was said to have died in a fire that resulted from an exploding mobile phone.
However, Fire Department investigations later concluded that there were traces of petrol in the room where Nazrin died, prompting the police to initiate a murder probe.
Samirah was held for questioning for 10 days, while her two sons were held for seven days.
