Khalid Samad files suit in capacity as a minister


Shah Alam MP Khalid Samad had last month filed his first defamation suit as federal territories minister, in which he named Gerakan Muslimah Malaysia leader Wan Asshima Kamaruddin as a defendant.
The action is on her posting on her Facebook in August, in which she attached a comment and video alleging that Khalid had approved the holding of the biggest LGBT event in Kuala Lumpur.
The suit was filed in the High Court in Kuala Lumpur on Sept 13 by the firm of Mohamed Hanipa and Associates.
Khalid, who is also Parti Amanah Nasional communications director, claimed that the posting, in its natural and ordinary meaning, meant that he approved the largest gay festival in the city centre during the month of independence.
The words also meant that he was willing to abuse the human rights of Muslims by approving such an event and that he, as an Amanah leader, recognises the LGBT in Malaysia.
It also meant that as a minister he does not respect Islamic laws as stated in the Quran and Sunnah (the practice of the prophet) and that he abused his position as minister to increase the status of the LGBT and their rights.
Khalid is seeking general, exemplary and aggravated damages and costs of the action.
The Federal Territories Minister claimed Wan Asshima had acted mala fide (in bad faith) in uploading the defamatory and false post to make Muslims hate him and as a result, it had tarnished his image and reputation, and generated public odium.
Khalid said that his lawyers had sent a letter of demand dated Aug 30 for the defendant to withdraw the post but she had not done so.
The matter came up for case management today before deputy registrar Rumaizah Baharom who fixed Oct 29 for further case management as Khalid's lawyers Nadzratun Naim Hammad Azizi had yet to serve the suit to Wan Asshma after two unsuccessful attempts.
